Term of Service

The following terms and conditions are the rules that all enrolled students (“You”) must abide by in order to use Lumenbrite Training’s services. These terms and conditions constitute a legal binding document, so please read them carefully.

Payment Terms

As an enrolled student, You agree to pay Lumenbrite Training (“Our,” “Us” or “We”) invoice in full upon receipt, but in any event, no later than before the first day of training class begins, whether the training is held on-site or off-site. You agree to pay in accordance with the payment terms stated on the invoice and according to the terms and conditions stated herein.

Purchase Orders for Our training services must be approved by Us prior to registration, and must be received at least 3 business days before the first day of class. Credit card charges on orders over $3,000.00 are subject to a 5% processing fee. All accounts will become delinquent 30 days after the invoice date and will be assessed a finance charge of 18% APR or the maximum rate of interest allowed by law, whichever is less.

All fees, payments, and amounts applied toward training services are nonrefundable. Once You are registered for a training class, You are responsible for and committed to attending and paying for the training class. However, if You notify Us in writing at least 10 business days prior to the scheduled training, We will apply Your payment, funds, or Purchase Orders minus a $150.00 non- refundable administrative fee toward a future training class that We offer.

Regarding Coronavirus

Lumenbrite is monitoring the Coronavirus and its impact on our training courses. At this time, our training events will continue as scheduled. If you are registered for a training but are unable to attend your scheduled date due to the virus, please contact us and we can reschedule you to a future date and/or arrange an Online Live/Virtual training with our Adobe Certified Instructors. If there are any changes to your course, we will notify you immediately. Please contact us at support@lumenbrite.com if you need to make any changes or if you have any questions.

Your Satisfaction is Guaranteed.

If You are not completely satisfied with Our training, You may retake Our Adobe training courses at a discount if you notify Us in writing. Retake fees are as follows, based on the length of time in between Your written notification and the original class start date of the Adobe Training course.

0 to 3 months: $100.00 retake fee 3 to 6 months: 60% off class

6 to 9 months: 40% off class

9 to 12 months: 20% off class

The retake class must be an already scheduled class at one of Our locations. You must bring Your original training materials and the version of the class must be the same as the original version that You attended. You will be allowed one retake class and must prepare Yourself by self-studying or by other means prior to retaking Your class. Our other training courses may be retaken on a case-by-case basis. We want You to be satisfied, so please contact Us for more information.

Legal

You are responsible for reviewing the course outline, which is listed on the website or may be obtained by contacting Us directly, to confirm that the class You are registering for will suit Your specific needs. We reserve the right to reschedule any course, training, or other contracted service

at any time due to unforeseen circumstances. In the unlikely event that a course must be cancelled, We will notify You, at the contact information that You have provided to Us, as soon as possible about when the course will be rescheduled. You are responsible for providing Us with Your current contact information. We are not liable for any travel-related expenses incurred by You do to the rescheduling of a training class, or otherwise.

If We incur any expenses in enforcing this agreement or collecting payment from You under this agreement, You agree to pay our reasonable and necessary attorneys’ fees and expenses.

Disclaimer

EXCEPT AS EXPRESSLY PROVIDED OTHERWISE IN AN AGREEMENT BETWEEN YOU AND LUMENBRITE TRAINING, NEITHER LUMENBRITE TRAINING NOR ANY THIRD PARTY HAS CONFERRED UPON YOU BY IMPLICATION, ESTOPPEL OR OTHERWISE, ANY LICENSE OR RIGHT UNDER ANY PATENT, TRADEMARK, OR COPYRIGHT.

EXCEPT AS EXPRESSLY PROVIDED OTHERWISE IN AN AGREEMENT BETWEEN YOU AND LUMENBRITE TRAINING, ALL INFORMATION, THE WEBSITE, AND PUBLICATIONS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND AND LUMENBRITE TRAINING HEREBY DISCLAIMS ALL WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, SUITABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. IN ADDITION, LUMENBRITE TRAINING DISCLAIMS ANY WARRANTIES OF NON-INFRINGEMENT, TITLE, OR QUIET ENJOYMENT. IN NO EVENT WILL LUMENBRITE TRAINING BE LIABLE FOR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM THE LOSS OF USE, LOSS OF DATA OR LOST PROFITS, WHETHER IN AN ACTION FOR BREACH OF CONTRACT OR WARRANTY OR TORT (INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THE INFORMATION, SOFTWARE, THE WEBSITE, OR THE PUBLICATIONS.

For example, if you register someone else for a class, you will need to submit that person's contact information. In this circumstance, the types of personal information collected are: Name, Address, Email address, Phone Number, etc.

We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send, or by contacting us.
